CONDITIONS OF ENTRY
Red Rooster Gold Medallions Meal Promotion Win a TV a day
  1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry must be made via Internet,1900 IVR call or SMS (premium call rate applicable) using SMS (short messaging service) enabled mobile phones. Some service providers and call plans may not provide access to premium SMS. Entrants must check with their service provider if unsure.

  2. Any costs associated with accessing the promotional website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.

  3. The promotion is only open to Australian residents aged 14 years or older who purchase a Red Rooster Gold Medallion Meal from a participating Red Rooster in Australia during the promotional period. Entrants entering via SMS must be identified as having a clear relationship with the end mobile device (evidenced by entrants entering by an SMS message originating from an MSISDN that identifies the entrant) and have the bill payer’s consent to enter by SMS. Employees (and their immediate families) of the Promoter and printers, suppliers, providers and agencies associated with this promotion are ineligible to enter.

  4. The promotion commences at 12:01am (AEST) on 06/07/2008 and closes at 11:59pm (AEST) on 09/08/2008. The prize draws will take place at 10.00am (AEST) daily over the promotional period at Oxygen Interactive Marketing, 2-6 Glenferrie Road Malvern VIC 3144. All prize winners will be notified by mail, phone and their details will also be published in The Australian and on the promotional website on the 31/07/08 for entries from 06/07/08 to 24/07/08 and on the 15/08/2008 for entries on 25/07/08 – 09/08/08. All reasonable steps to notify winners of the results of the draws will be taken by the Promoter.  Judges' decision is final and no correspondence will be entered into.

  5. To enter the promotion, eligible entrants must purchase a Red Rooster Gold Medallion Meal from a participating Red Rooster in Australia during the promotional period. They will receive an entry card and are to locate their unique code and then enter by one of the following methods:
    1. Send an SMS in the required format to 19914242 during the promotional period. The required SMS format is “UNIQUE CODE” + space + “ENTRANT’S NAME” OR

    2. Telephone 1900 91 42 42 and respond to the automated voice prompts, leaving their full name, postal address, telephone number, current valid email address, store name where the Red Rooster Gold Medallion Meal was purchased and the unique code.

    3. Log onto www.goldmedallions.com.au and complete in full in the manner required and submit the online entry form during the promotional period. In order to fully complete the online entry form, eligible entrants will be required to provide their full name, residential address, contact telephone number, current and valid email address and their unique code from their entry form.

  6. SMS entries must be sent from a mobile phone handset and be identified by a MSISDN (unique mobile SIM number) for security reasons to be eligible. Entrants via SMS or 1900 IVR call must have the bill payer’s permission to enter the promotion or their entry will be invalid.  Any form of automated entry using the Internet or any other device or software is invalid. Max SMS cost is $0.55 (including GST). Any SMS submitted after the promotion period has closed will not be included in the promotion and will be charged $0.55 cents (including GST). The charges for all SMS entry services will appear on each entrant's next mobile phone bill. All queries relating to mobile bills should be directed to the entrants' mobile phone carrier. 1900 call costs 55 cents, may be higher from mobile phones.

  7. Incomplete, ineligible or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries. Entries must be received by the Promoter during the promotional period. SMS and Internet entries will be deemed to be accepted at the time of receipt into the promotional database and not at the time of transmission.

  8. A reply SMS will be sent to each entrant submitting an entry by SMS immediately after their entry has been received, confirming their entry has been successfully received. If an SMS entry is not successful because it is not in the required SMS format or the unique code submitted by an eligible entrant is not recognised by the Promoter as an eligible unique code for the promotion, a “try again” message will be sent to the entrant. The “try again” message will prompt the entrant to check their unique code and resubmit their SMS entry in the required form. If the entrant elects to resubmit their SMS entry, the entrant will be charged an additional $0.55 cents (including GST).

  9. Multiple entries will be accepted but on each occasion eligible entrants must fully comply with the entry requirements. Each entry must be based on a separate purchase of a Red Rooster Gold Medallion Meal and must contain a separate unique number from an entry card based.

  10. Each eligible entrant must retain entry card with their unique code as entrants may be requested to provide to the Promoter proof of all entries made. If an entrant is unable to provide proof for all entries made, then all the entries of that entrant will be ineligible and deemed invalid.

  11. Entrants can only enter in their own name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim a prize, that the entrant obtained the bill payer’s consent to enter by SMS before submitting their entry/entries (if applicable), that the entrant has a clear relationship with the end mobile device used to enter via SMS (if applicable), and any information submitted by the winners in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winner’s entry will become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

  12. The Daily prize draws will take place at 10.00am (AEST) daily over the promotional period. The prize draws will take place at Oxygen Interactive Marketing, 2-6 Glenferrie Road Malvern VIC 3144.

  13. Daily Prizes: All eligible entrants who enter the promotion in accordance with the entry requirements stated above will be entered into the daily draw. The first eligible entry randomly drawn from all eligible entries received for each Draw Time on each Draw Date (as stated below and appendix 1) will win one (1) Samsung 116cm LCD TV LA46A550P1FXXY (Recommended Retail Price $3299 including GST). There are thirty five (35) individual prize winners. The Daily prize draw will take place at 10am on a daily basis from Monday to Friday from the preceding days valid entries. The draws for Friday and Saturday will take place on the following Monday morning. In the event that the draw day is a public holiday then the draw will occur on the next working day. The Daily prize winners will be notified by mail, SMS or email. All prize winners will be notified by mail, phone and their details will also be published in The Australian and on the promotional website on the 31/07/08 for entries from 06/07/08 to 24/07/08 and on the 15/08/2008 for entries on 25/07/08 – 09/08/08. (Please see appendix 1)All reasonable steps to notify winners of the results of the draws will be taken by the Promoter.  Judges' decision is final and no correspondence will be entered into. Prizes will be dispatched within 28 days.

  14. The total prize value is up to $115 465.00 (Recommended Retail Price including GST). Prizes must be taken as offered and cannot be varied. Prizes are not transferable or exchangeable and cannot be taken as cash. Any unused portion of the prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.

  15. The Promoter may conduct such further draws as are necessary at 10:00am (AEST) at the same place as the original prize draws on 10/11/2008 in order to distribute any prizes unclaimed by that date, subject to any written directions given under Regulation 37 of the Lottery and Gaming Regulations 1993 (SA) or other State or Territory legislation. All winners in any unclaimed prize draw will be notified by mail SMS or email and their name and will be published in The Australian and on the promotional website on the 17/11/2008.

  16. If any prize or any element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions under State or Territory legislation.

  17. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

  18. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.  The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

  19. Caution: any attempt to cause malicious damage or interference with the normal functioning of the SMS applications, 1900 IVR call applications, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.

  20. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

  21. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.

  22. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

  23. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.

  24. The winners agree to participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents and sign any release document provided by the Promoter, in its absolute discretion. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner of a draw (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  25. All entries and any copyright subsisting in the entries become and remain the property of the Promoter.  The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. The Promoter also may: (a) use the information to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages; and (b) share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way, should you not opt-out of receiving such information. To opt-out, send a reply SMS (charged at standard carrier rates) with the word ‘STOP’ to the confirmation SMS sent to you if entering by SMS or tick the opt-out button on the online entry form if entering on the promotional website. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
